1. Acceptance of Terms

By accessing and using the website at botgaugex.com and the BotGauge platform (the "Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

BotGauge provides an autonomous quality assurance (QA) and testing automation platform that enables engineering teams to automatically generate, run, and maintain software tests. The Service includes the BotGauge web application, CLI tool, API, documentation, and related services.

3. Use of the Service

You may use our Service for lawful purposes only. You agree not to:

  • Use the Service in any way that violates applicable laws or regulations
  • Use the Service to test applications or systems for which you do not have authorization
  • Attempt to gain unauthorized access to any part of the Service or its related systems or networks
  • Transmit any viruses, malware, or other harmful code through the Service
  • Use the Service to send unsolicited or unauthorized advertising or promotional material
  • Interfere with or disrupt the integrity or performance of the Service
  • Engage in any conduct that restricts or inhibits anyone's use of the Service
  • Reverse engineer, decompile, or disassemble the Service except as permitted by applicable law
  • Use the Service to compete with BotGauge or build a similar or competitive product

4. Accounts

When you create an account with BotGauge, you must provide accurate, complete, and current information. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

5. Intellectual Property

The Service and its original content, features, and functionality are owned by BotGauge and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of any code or test artifacts you generate using the Service, subject to the license terms below.

BotGauge grants you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

6. User Content

When you submit application code, configurations, or other materials to the Service for analysis or testing ("User Content"), you grant BotGauge a limited, worldwide, royalty-free license to use that content solely to provide the Service to you. BotGauge will not use your User Content to train machine learning models without your explicit consent. You represent and warrant that you have all necessary rights to submit such content.

7. Payment and Subscriptions

BotGauge offers free and paid subscription plans. By subscribing to a paid plan, you agree to pay the applicable fees. Fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as expressly stated in these Terms. We reserve the right to change our pricing with 30 days' advance notice.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. BotGauge does not warrant that:

  • The Service will be uninterrupted or error-free
  • The results obtained from using the Service will be accurate or reliable
  • Any errors in the Service will be corrected
  • The Service is free from viruses or other harmful components

9. Limitation of Liability

To the fullest extent permitted by law, BotGauge shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of profits, data, goodwill, or other intangible losses, even if BotGauge has been advised of the possibility of such damages. BotGauge's total liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid to BotGauge in the twelve months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless BotGauge and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

Our Service may contain links to third-party websites or services. These links are provided for your convenience only. BotGauge has no control over the content of those websites and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

12. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

13. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. 14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in courts located in San Francisco, California.

We reserve the right to modify or replace these Terms at any time. We will provide notice of any significant changes by posting the new Terms on this page and updating the "last updated" date.
